1.2   You must read these terms and condition carefully before using this site.

1.3   By using this site, you are agreeing to be bound by these terms and conditions and the documents referred to in them. This includes our privacy policy, cookie policy and terms and conditions. If you do not agree to anything in these terms, then you must cease using the site immediately.

1.4   You must be at least 18 years of age to use our website; by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.

For the duration of this agreement, the following terms apply with the following meanings:

2.1 “Classes” means any Pilates (online or otherwise) and Mindfulness classes available either as free or paid content.

2.2  “Content” this is used to universally describe all information produced and stored on our sites. This may include videos, audio, images, online classes, blog posts, articles, fact sheets, exercise guides, mediations, workbooks and mindfulness or other material submitted to or on our site.

2.3   “Cookie Policy” how we use cookies on our site and the policy used to explain it.

2.4   “Privacy Policy” the policy that governs how we process personal data collected from you.

2.5  “Terms” means these terms and conditions of use which may be updated from time to time in line with section 10.

2.6   “Users”, “User”, “You “or “your” means any third party that accesses the site

2.7    “We”, “Us”, “Our” refers to Physio 2 Pilates Limited, a company with Company Number 10642546 and with its registered address at Office 8, Kings Court, 17 School Road, Hall Green, B28 8JG

  1. Use of the site

3.1    You may only use our website for your own personal use, and you must not use our website for any other purposes.

3.2   You agree that you are solely responsible for any costs and expenses that you may incur in your relation to your use of this site.

3.3   You agree that you are solely responsible for any exercise program followed at home as exercises are not directly supervised

3.4   You agree, except as expressly permitted to do so in writing by Physio 2 Pilates Limited, you will not reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer or disassemble any part of the site.

3.5   You agree not to make any attempts to or actually interfere with the site

  1. Accuracy of information and use of the site

4.1   Your use of this site and its content is for general information purposes only and does not in any way provide personalised medical advice nor does it replace the need to seek medical advice.

4.2   You acknowledge that any information on this website is for educational purposes only and does not form any type of diagnosis or constitute healthcare or medical advice.

4.3   Whilst the site is constantly under review and updated, we can make no warranty implied or express to its accuracy, completeness or appropriateness for any purpose. Any reliance that you may place on the information on our site is at your own risk.

4.4   In relation to the aforementioned, developments in medical research may impact on health, fitness or medical information that appears on this site. No assurance can be given that the advice contained on site will always include the most recent findings or developments with respect to the particular material.

  1. Medical Disclaimer Online Exercises

5.1   It is recommended that you discuss with your GP or Health Professional prior to commencing any new exercise programme.

5.2   We recommend that you commence with the beginner’s exercises and progress as you feel ready to.

5.3   Different levels will be shown with in each programme, and you are advised to work to a level that you feel comfortable with and not progress the exercises until you feel ready.

5.4   It is important to realise that you should stop whenever you wish, especially if you feel tired or any discomfort.

5.5   None of the exercises should cause you to experience any pain. If you should experience any pain from any of the exercises you should stop immediately.

5.6   With any exercise, there exists the possibility of certain dangers such as abnormal blood pressure, fainting, irregular/fast or slow heart rhythm. It is impossible to predict the body’s exact response to exercise, therefore if you have any medical issues these need to be discussed with the appropriate healthcare professional before commencing any programme.

5.7 If you attend our classes, please discuss starting any online exercises with your class instructor who can sign post you to the most appropriate level for you to work at.

5.8   Do Not undertake any of the exercises included on this website, blog, newsletter or emails, if any of the following applies to you:

  • A Doctor or other Healthcare Professional has ever informed you that you should refrain from exercising or undertaking Pilates for any reason.
  • A Doctor or other Healthcare Professional has ever informed you that you have a heart condition or that you should only exercise under direct supervision of a Doctor or other Healthcare Professional.
  • You are suffering from uncontrolled high blood pressure or low blood pressure.
  • You are suffering from any undiagnosed pain or are generally feeling unwell.
  • You have undergone any surgery in the past 6 months or have any injuries. Please discuss starting Pilates with your consultant or Healthcare Professional before attempting any exercises.
  • You have any joint or muscular issues that maybe aggravated by exercise.
  • You are pregnant, breastfeeding or lactating

This is not an exhaustive list and you acknowledge and understand that any physical exercise can expose the risk of serious injury. We strongly advise that if you are unsure if Pilates is suitable for you, you seek medical advice before commencing any exercises.

  1. Hyperlinks and Third-party Sites

6.1   Our website includes hyperlinks to other websites owned and operated by third parties; such hyperlinks are not recommendations.

6.2   We have no control over third party websites and their contents, and subject to Section 9 we accept no responsibility for them or for any loss or damage that may arise from your use of them.

6.3   The displaying of any hyperlinks does not mean that we endorse those sites or any of their content or services.

6.4    Your use of any third-party sites is at your own risk, and you shall be governed by their terms and conditions

  1. Booking Software and Payment Software Usage Terms (ClassFit Software)

7.1   Our booking and payment software is handled by ClassFit. This is an external company with their own terms and conditions of use.

7.2   By using the booking and payment software on this site you are agreeing to be bound by their terms and conditions as well.

7.3   We do not store any card information at any time. There is however a facility for you to store your card details on the ClassFit system. This is done at your own risk.

7.4   We are not responsible for the security of the ClassFit site as this is an external site and subject to its own security checks. Please contact ClassFit directly if you have any questions relating to security.

7.6   To fully access our booking system you are required to register online. You agree to providing us with your name, e-mail address, country and a contact telephone number as a minimum requirement of registration.

7.7  Accounts must be set up in your name and not someone else’s. Each person wanting to make a booking will need their own unique account.

7.8   Your username may not use someone else’s name, a name that violates any third party right, or a name that is obscene or objectionable.

7.9   You must select a password which complies with the terms set out by ClassFit.

7.10  It is your responsibility to keep this password safe and secure. Do Not use a password that you have used before or that is used on another site.

7.11    If you are using a computer that others may have access to, you must ensure that you log out of your account after using our booking software.

7.12   If you become aware of any unauthorised access to your account, you must change your password and notify us immediately at [email protected].

7.13   You are responsible for notifying us and changing your password immediately. We cannot be held responsible for any unauthorised access to your account, and you are fully responsible for all activity that occurs under your account. Activity means, but is not exclusively restricted to, any and all cancellations, bookings or payments that are made in your name.

7.14  Should you not wish to use our booking system to make your payment, please contact us directly and we will see if we can arrange an alternative method such as a Bacs transfer. We would still however need to enter your details into our booking system to reserve you a place in the class requested.

  1. Company Name and Logo

8.1   You may not use our logo or trade name or trademarks without express written consent except accordance with these terms.

  1. Limitation of Liability

9.1   Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for any:

9.1.1   losses that:

          were not foreseeable to you and us when the contract was formed

          that were not caused by any breach of these terms on our part

9.1.2   business losses, including loss of business, loss of profits, loss of management time and loss of business opportunity.

  1. Variation

These Terms are dated 31st October 2022. This agreement may not be modified or altered in any way except by a revised term posted by us. The revised terms will come into effect on the date it is posted on the site. And by continuing to use the site following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these terms from time to time to verify such variations.

  1. Governing Law

11.1   The laws of England and Wales will apply to this contract and any dispute arising from or in connection with them.

11.2   Each of the parties submits to the exclusive jurisdiction of the courts in England and Wales.
